General Terms and Conditions (GTC) for the holiday accommodation Da Salvaotore Landlord: Salvatore Marino Halbinselstraße 75, 88142 Wasserburg, Germany
1. Arrival/Departure: Saturday from 4:00 PM until the following Saturday at the latest by 10:00 AM. Arrival and departure times also apply to individually agreed-upon weekdays. Departure must be no later than 11:00 AM on the departure day. Exceeding the departure time by more than 30 minutes will result in an additional night's charge. Alternative arrival and departure times can be arranged individually with the landlord. If the tenant does not arrive by 10:00 PM on the arrival day, the contract will be considered terminated after a 24-hour period without notification to the landlord. The landlord is then free to dispose of the property. A (partial) refund of the rent due to early departure is generally not granted. If non-tenants (visitors) are staying overnight, the landlord must be informed of the number of visitors and the length of their stay before arrival. The rental costs may increase accordingly. ...
2. Payment The rental agreement becomes valid upon receipt of the deposit in the landlord's account. The deposit, amounting to 50% of the rental price, is due within seven days of receiving the booking documents. The remaining balance is due 30 days prior to arrival. If the payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is considered a cancellation and entitles the landlord to re-let the property. The total amount stated in the rental agreement includes utilities (water, energy, final cleaning, waste disposal, TV license fee = 7% VAT) as well as the service fee (parking, use of playground and sports equipment = 19% VAT). All prices on our website vary and may be higher or lower in individual cases.
3. Cancellation You may cancel the contract at any time. Cancellation must be made in writing (letter or email). In the event of cancellation, you are liable for the following damages incurred by us: • From the date of receipt of the deposit payment by the renter until 121 days before the start of the rental period: €25 processing fee • From 120 days to 61 days before the start of the rental period: the amount of the deposit plus a €25 processing fee • From 60 days to 15 days before the start of the rental period: 50% of the total price plus a €25 processing fee • For cancellations less than 14 days before the start of the rental period, the full rental price is payable. The date of receipt of your cancellation notice is decisive. Any amounts already paid will be credited. You may nominate a substitute tenant who will assume your contract under the aforementioned conditions. Written notification is sufficient. The renter will receive a recommendation to take out travel cancellation insurance with the booking documents.
4. Renter's Obligations The renter is obligated to treat the rented property (holiday home, inventory, and grounds) with care. If any damage occurs to the holiday home and/or its contents during the rental period, the tenant is obligated to report this to the property management immediately. Any defects or damage discovered upon arrival must be reported to the property management immediately (by 8 p.m. on the day of arrival); otherwise, the tenant will be liable for these damages. A reasonable period must be allowed for the repair of any damage or defects. Claims arising from complaints that are not reported immediately on-site are excluded. Complaints received by the landlord only at the end of the stay or after departure from the holiday home are also excluded from compensation. In the event of any service disruptions, the tenant is obligated to do everything reasonably possible within the scope of their legal obligations to contribute to resolving the disruption and to minimize any resulting damage. On the day of departure, the tenant must remove all personal belongings, dispose of household waste in the designated containers, and store clean, washed dishes in the kitchen cupboards. The property must be left free of litter. Subletting the property by the tenant or allowing overnight stays by non-tenants in the holiday home and/or on the grounds without the landlord's knowledge is strictly prohibited (see also point 1). Violations will result in immediate termination of the rental agreement by the landlord, and the property must be vacated immediately. Should the tenant leave behind personal belongings and fail to report them, these items will be disposed of after a storage period of six months following departure. Charging electric vehicles using the holiday home's electrical system is strictly prohibited. The wiring is not designed for this purpose. Several electric vehicle charging stations are located within a 15 km radius.
5. Pets are not allowed in the Da Salvatore guesthouse.
6. Data Protection: The tenant agrees that data concerning their person, necessary for the execution of the rental agreement, may be stored, modified, and/or deleted. All personal data will be treated with absolute confidentiality and will not be shared with third parties. The tenant has the right to object to the storage of their data at any time. Deletion will take place within a reasonable timeframe, provided there are no legal requirements (e.g., tax regulations) to the contrary. The customer agrees to receive invoices electronically.
7. Liability: This listing was prepared to the best of our knowledge. We are not liable for any disruption to the rental property caused by force majeure, power or water outages common in the region, or severe weather. Likewise, we are not liable for unforeseen or unavoidable circumstances such as official orders, sudden construction work, or disruptions caused by natural or local conditions. The landlord will gladly assist in resolving any problems (to the extent possible). The landlord accepts no liability for the use of the provided play and sports equipment. The tenant is responsible for their own arrival and departure. The landlord is not liable for personal belongings in case of theft or fire. The tenant waives all claims for damages in this respect. The tenant is fully liable for any willful destruction or damage.
8. Final Provisions: Photos and text on the website or in the flyer serve as a realistic description. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture), provided they are of equivalent value. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the economic and legal intent of the contracting parties. German law applies. The place of jurisdiction and performance is the landlord's place of residence.
